Welcome to Havan Kund. These Terms of Service govern your use of our website (havankund.com.au) and your purchase of our products. By accessing our website or placing an order, you agree to these terms. If you do not agree, please do not use our website.
1. About Us
This website (havankund.com.au) is operated by The Trustee for Chordia Family Trust (ABN 79 114 603 979). “Havan Kund” is the online store brand of that entity. References to “we”, “us” and “our” mean the operator of this website.
2. Eligibility
By placing an order, you confirm that you are at least 18 years old, or that you have the permission of a parent or legal guardian to make the purchase.
3. Account Registration & Security
• Some features may require you to create an account. You are responsible for keeping your account details confidential and for all activity under your account.
• You agree to provide accurate, current and complete information and to keep it up to date.
4. Use of Our Website
• You agree to use our website lawfully and in line with all applicable laws.
• You must not use our website in any way that could damage, disable, overburden or impair it, or interfere with any other user’s access.
• We may suspend or terminate your access if we reasonably believe you have breached these terms.
5. Orders & Acceptance
• Your order is an offer to purchase. A contract is formed only when we accept your order and dispatch your goods or confirm acceptance in writing.
• We may decline or cancel an order – for example, where stock is unavailable or where a pricing or product error has occurred. If we cancel an order you have paid for, we will refund you in full.
6. Pricing & GST
• All prices are shown in Australian Dollars (AUD) and include GST unless stated otherwise.
• We try to keep all product descriptions, images and pricing accurate, but we do not warrant that they are always error-free. We may correct errors and update information at any time without prior notice.
• Product images are for illustration. As our fire pits are made from steel, slight variations in finish, colour and texture are normal.
7. Title & Risk
Ownership of the goods passes to you once payment has been received in full. Risk in the goods passes to you on delivery.
8. Product Safety & Responsible Use
Our products are metal vessels designed to hold a small ceremonial or open fire (for example, for havan, homa or puja). They involve an open flame and become very hot, and can cause injury, fire or property damage if used without proper care. By purchasing, you acknowledge and agree that:
• You will read and follow any instructions and safety guidance supplied with the product.
• You will place the product on a stable, level, heat-proof and non-combustible surface, and protect nearby floors, surfaces and furnishings from heat and embers.
• When used indoors, you will ensure adequate ventilation and keep the product well clear of curtains, decorations, clothing, ceremonial materials and anything else that can catch fire.
• When used outdoors, you will comply with all local council regulations, fire-safety laws and total fire bans that apply in your area.
• You will keep a means of extinguishing the fire close at hand, never leave the fire unattended, and keep children and pets at a safe distance.
• You will allow the product to cool completely before handling, moving or storing it.
To the extent permitted by law, we are not responsible for loss or damage arising from misuse of the product, failure to follow the supplied instructions, inadequate ventilation, or failure to comply with applicable fire restrictions or laws. Nothing in this clause excludes your rights under the Australian Consumer Law.
9. Intellectual Property
• All content connected with our business – including website text, graphics, logos, images, product photographs, product designs (where applicable), marketing material and our name and logo – is our property or licensed to us and is protected by intellectual property laws.
• You may not reproduce, distribute, modify or use any of this content without our prior written permission.
10. Consumer Guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or excludes any rights or remedies you have under the ACL or other applicable law.
11. Limitation of Liability
To the maximum extent permitted by law, and subject to the consumer guarantees above, we are not liable for any indirect, incidental, special or consequential loss arising from your use of our website or products. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the goods or paying the cost of re-supplying them.
12. Force Majeure
We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, extreme weather, fire, industrial action, supplier shortages, transport disruptions, pandemics or government restrictions.
13. Governing Law
These terms are governed by the laws of Victoria, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.
14. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, constitute the entire agreement between you and us regarding purchases made through havankund.com.au.
15. Changes to These Terms
We may update these terms at any time. The latest effective date will be shown at the top of this page. Continued use of our website means you accept the updated terms.
